Ok... Some of us didn't even know that this also impacted the 12-15 year old riders! It does appear that our voices are being heard! The 12-15 year old Units has now been approved!
Please keep your voice loud to the CSPC! It is working! I have copied and pasted an article by Joe Delmont that I found on ATV Young Guns this afternoon.
Keep it up!
Amy
CPSC Approves Sale of Units for 12- to 15-year-olds
Publish date: Feb 15, 2009
Dealernews / Joe Delmont
Consumer Product Safety Commission (CPSC) said Saturday it has heard the concerns of the motorcycle and ATV industries and riders and is responding by taking action to meet their needs. The agency has decided that machines designated for youths ages 12 to 15 - formerly the Y12 category - are not prohibited under new lead content regulations and can be sold, an agency representative confirms with Dealernews.
"It's time for everyone to be aware that those models for youths 12 to 15 are not deemed to be children's products under the law," said Scott Wolfson, a CPSC spokesman. "Those that are the old Y12 or any newer version of a model [for 12- to 15-year-olds] do not have to come off showroom floors and can be sold appropriately to young riders," he says.
The agency is charged with implementing the Consumer Product Safety Improvement Act (CPSIA) that was signed by President Bush last August. The law limits the amount of lead in paint and materials contained in products designed primarily for youth ages 12 and under.
Wolfson said dealers should "keep in touch with CPSC. We have heard the voices of those throughout the industry and those who are riders. We're working as hard as we can as an agency. We have a vast child safety law we are continuing to interpret and implement in the right way."
While Wolfson said he could not provide a date when the agency would be able to act upon petitions presented to it by the MIC/SVIA that would permit the sale of youth products, he urged dealers to view the situation calmly.
"We really want to calm down dealers," he says. "They should get (the youth models) off their showfloors and back into holding areas. It's only been a matter of days since we received the industry's petitions.
"We're dealing with more than ATVs - we're dealing with every single product for children under 12," Wolfson continues. "We need a little bit more time to process the petitions and make assessments. We want our decisions to be based upon sound legal judgments."
Wolfson said the agency is reviewing situations based upon child safety factors, the law as it's written, and priorities and resources within the agency.
"The industry needs to settle down," he says, "and give the agency the appropriate amount of time to review the petition and make sound decisions that will benefit everyone in the marketplace."
The new regulations went into effect Feb. 10. Any products for children that don't meet the requirements specified in the law cannot be sold. These items include ATVs, dirtbikes, apparel, and related parts and accessories, in addition to many other products for children.
ATVRE Editor's Note: Make your voice heard. Go to www.tomself.com to send a letter to congress to support the youth of our sport under the age of 12.

AMA Calls Motorcyclists to Help Stop Youth OHV Ban
Feb 12 2009 10:10AM

PICKERINGTON, Ohio - The sport of off-highway recreation is seriously threatened by recent legislation that imposes strict lead content guidelines on children's everyday toys. The Consumer Product Safety Improvement Act of 2008 (CPSIA) has effectively banned the sale of youth off-highway vehicles (OHVs). The American Motorcyclist Association (AMA) is calling for action now to help reverse the potentially devestating effect this could have on the sport of OHV recreation.
"The unavailability of youth OHVs will devastate family OHV recreation and cripple amateur competition, creating a domino effect across all aspects of motorized recreation," said AMA Vice President for Government Relations Ed Moreland. "All motorcyclists, whether they recreate off-road or not, need to come to the defense of our youngest riders and help ensure the future availability of youth OHVs."
A quick and effective way to help is to write or call your representative and the Consumer Product Safety Commission (CPSC) and let them know petitions exist to exclude certain vehicles from the final rule governing the law. You can send your representative a letter by using the Take Action button in the Issues and Legislation section of www.AmericanMotorcyclist.com. To contact the CPSC directly, use the contact form here.
According to section 101(a) of the enacted legislation, all youth products containing lead must have less than 600 parts per million (ppm) by weight. The CPSC has interpreted the law to apply to various components of youth OHVs including the engine, brakes, suspension, battery and other mechanical parts. Even though the lead levels in these parts are small, they are still above the minimum threshold.
In order to assure continued availability and access to youth OHVs, the Motorcycle Industry Council (MIC) and Specialty Vehicle Industry Association (SVIA) submitted petitions to the CPSC asking that certain vehicles be excluded from the final rule governing the law.
"It is critical that Congress and the CPSC know that these petitions exist and that by acting on them they will maintain a vital form of recreation for American families, preserve youth racing and protect the thousands of jobs associated with this industry," Moreland added. "We are asking all motorcyclists to write or call their representatives and the CPSC today and ask them to approve the petition to exclude youth OHVs from the CPSIA lead content requirements."

Kaysie decided tonight that she wanted to write a letter to Senator John Cornyn. Before mailing it tomorrow I wanted to post it on here for all of you to read.
Dear Mr. John,
I have fun racing my fourwheeler! It is the beginning of the race season. I am 10 years old and so far I'm in 1st place. How will I keep it up if I don't have the parts and my safety gear that fit me? By the way I'm in Sr. Mini. If my mom and dad can't get the parts and gear I won't be able to race anymore. So, what will I be able to do that is as fun as racing?
Your friend,
Kaysie
p.s. Please wirte me back!! or call me
Ok... so I corrected the spelling mistakes but that is it. The rest of this letter is her word for word!

We all need to call and write letters. I found the following website that helped me locate my local representatives as well as links to Texas Senators John Cornyn and Kay Bailey Hutchison.
http://www.fyi.legis.state.tx.us/
Simply fill in your address and a list of your representatives with contact information will follow.
This really goes so much further than the government making laws that will dictate what we are allowed to do for fun - look at the economical impact this will have on so many motorcross businesses. Consider the inventory these businesses have already spent money on but now are unable to sell. Sure some of these places are plenty big to absorb those costs, but look at the small (mom and pop) type places that depend on every penny that comes in. Also consider the tracks we ride at; without the smaller bikes and a reduction of parts to repair the larger ones fewer and fewer people will be able to go ride and support them.
I'm working on my letter now!!! _________________ Take care and God bless,
